Terms of Service

Welcome to AIWriter Pro. These Terms of Service ("Terms") govern your access to and use of the AIWriter Pro website and AI writing services ("Service") operated by AYTech ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Account Registration

• You must provide a valid email address and accurate information during registration
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activity that occurs under your account
• You must notify us immediately at shaojie90@gmail.com if you suspect unauthorized access to your account
• You may not create multiple accounts to circumvent usage limits

3. Subscription Plans and Billing

• Free Plan: 10 AI generations per month, no credit card required
• Basic Plan: $9.9 USD per month, 200 AI generations per month
• Pro Plan: $19.9 USD per month, 1,000 AI generations per month
• Paid plans are billed monthly, in advance, through Creem payment processing
• Prices are in USD and do not include any applicable taxes
• Generation counts reset on the 1st of each calendar month
• Unused generations do not roll over to the next month

4. Cancellation and Refund Policy

• You may cancel your subscription at any time from your Dashboard. Cancellation takes effect at the end of the current billing period
• Upon cancellation, your account will be downgraded to the Free plan
• Refunds: We offer a 7-day refund on your first paid month if you are not satisfied. To request a refund, contact us within 7 days of your first charge at shaojie90@gmail.com
• Refunds are not available for subsequent billing periods

5. Acceptable Use

You agree not to use the Service to:

• Generate spam, phishing content, or mass unsolicited communications
• Create content that is defamatory, harassing, threatening, or violates the rights of others
• Generate content that violates any applicable laws or regulations
• Produce content intended to deceive or mislead others (e.g., fake news, disinformation)
• Attempt to reverse-engineer, scrape, or extract the underlying AI models
• Circumvent usage limits by sharing accounts or using automated tools
• Use the Service for any illegal purpose

6. Intellectual Property

Your Content: You own the content you create using AIWriter Pro. You grant us a limited license to store and process your content solely for the purpose of providing the Service.

Our Platform: The AIWriter Pro software, design, and branding are owned by AYTech. You may not copy, modify, or redistribute any part of our platform without written permission.

AI-Generated Content: You acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions. You are responsible for verifying the originality and legality of any content you publish.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, error-free, or available at all times
• AI-generated content will be accurate, original, or fit for any particular purpose
• The Service will meet your specific requirements

Use of AI-generated content for any purpose (legal, medical, financial, journalistic, etc.) is at your own risk. Always review and verify AI-generated content before publishing.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AYTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance, and AI model availability depends on third-party providers (Zhipu AI, Google Gemini). We are not liable for outages caused by third-party AI providers.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, without refund. You may also delete your account at any time by contacting us at shaojie90@gmail.com.

11. Changes to Terms

We may update these Terms from time to time. We will notify you by email of material changes at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Singapore. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration if necessary.
